Art. 185. The net remainder of the conjugal partnership of gains shall be divided equally between the husband and the wife or their respective heirs, unless a different basis of division was agreed upon in the marriage settlements.  


Discussion/Explanations:

         This article says that the profits refers to the net remainder of the conjugal properties, that is, after paying the conjugal obligations. In this conjugal obligation such the credits and charges in the conjugal partnership.

          Upon gaining this net remainder of the conjugal partnership it should be divided equally in between husband and the wife of even  their respective heirs. They are who should have a right to get their shares upon it. Otherwise, their are some instances or basis that would change the form division of the properties. There is, if it is a marriage couple made a decision and settle it upon the agreement. Therefore, the division is just depends on what their are already settled agreement in between of a marriage.
